Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TradeBooked platform ("TradeBooked", "we", "us", "our"). By creating an account or using TradeBooked, you agree to these Terms in full. If you do not agree, do not use the service. Questions about these Terms can be sent to compliance@tradebooked.co.uk. Effective date: 6 April 2026 1. WHAT TRADEBOOKED IS TradeBooked is a software platform for UK-based tradespeople. It enables businesses to manage online booking pages, accept and organise bookings, communicate with customers, collect deposits, and carry out related business administration. TradeBooked is a technology platform only. We are not a party to any contract between a tradesperson and their customer. We are not a trades agency, contractor, or employer. We accept no responsibility for the quality, safety, legality, or outcome of any work carried out by a tradesperson. Customers who book through a tradesperson's TradeBooked page are contracting with the tradesperson, not with TradeBooked. 2. ELIGIBILITY AND ACCOUNTS To use TradeBooked as a tradesperson, you must be at least 18 years old and operating a legitimate trade business. You must provide accurate, current, and complete information when creating your account and keep it up to date. You are responsible for: - maintaining the confidentiality of your login credentials - all activity carried out through your account - ensuring only authorised people access your account - notifying us promptly at compliance@tradebooked.co.uk if you believe your account has been compromised We may suspend or terminate access where we reasonably believe an account is being misused, used unlawfully, involves inaccurate information, or creates security, legal, or operational risk to TradeBooked or its users. 3. FREE TRIALS We may offer a free trial period on sign-up. Trial duration, terms, and included features may vary and may differ for future users. During a trial, access to certain features may be limited. If you do not activate a paid subscription before your trial ends, we may restrict or suspend access to paid features — including your public booking page — until a valid paid subscription is in place. We will take reasonable steps to notify you before this happens. 4. SUBSCRIPTIONS AND BILLING TradeBooked subscriptions are billed monthly or annually in advance through Stripe. By subscribing, you authorise us and our payment provider to take payment in line with the selected plan and billing interval. Unless stated otherwise at the time of purchase: - subscriptions renew automatically at the end of each billing period - you may cancel at any time before the renewal date - cancellation takes effect at the end of your current paid period — you retain access until then - fees already paid are generally non-refundable except where required by law If payment fails, we may automatically retry your payment method. We may suspend, restrict, or downgrade access to features or the service if payment cannot be collected. We will notify you of payment failures. We review our pricing periodically. We will give you at least 30 days' written notice of any price change before it applies to your existing subscription. Continued use after a price change takes effect constitutes acceptance. Feature availability varies by plan. We may add, remove, or modify plan features from time to time. We will take reasonable steps to notify you of material changes to the plan you are on. 5. BRANDED KIT ORDERS (MADE TO ORDER) TradeBooked may offer branded workwear and merchandise ordering. Where items are printed or customised, they are made to order and produced by a third-party fulfilment partner (currently Printful). By placing an order, you confirm the artwork, details, and quantities are correct. Made-to-order items generally cannot be cancelled once production has begun. Returns: made-to-order items are non-returnable unless faulty or misprinted. If an item arrives faulty or incorrectly produced, contact us within 14 days and we will arrange a replacement or refund as appropriate. Delivery timeframes are provided as estimates and may vary. We are not responsible for delays caused by fulfilment partners or couriers outside our reasonable control. These terms are in addition to Printful's own terms, which apply to the production and fulfilment of your order. 6. DEPOSIT PAYMENTS (AUTOPILOT PLAN) Where the Autopilot plan is active and deposit collection is enabled, TradeBooked facilitates customer deposit payments on your behalf using Stripe Connect. By enabling this feature, you agree to Stripe's Connected Account Agreement. TradeBooked does not hold, collect, or retain customer deposit funds. Payments are processed directly to the tradesperson's connected Stripe account. TradeBooked takes no commission on deposit transactions. Payment processing outcomes — including authorisations, reversals, refunds, chargebacks, disputes, reserves, and payout timing — are governed by Stripe's rules and applicable payment network requirements. You are solely responsible for: - setting and communicating your cancellation and refund policy to customers before they pay a deposit - issuing refunds where your policy or applicable law requires it - all disputes arising from deposit payments, cancellations, or refunds - keeping your Stripe connected account active, verified, and linked to valid bank payout details - maintaining sufficient funds to cover any refunds, disputes, or payment reversals - providing accurate evidence and timely cooperation in any dispute resolution process Customers will be shown your cancellation policy at the time of booking and must acknowledge it before any deposit payment is taken. To the extent permitted by law, if TradeBooked incurs unrecovered losses, fees, fines, refunds, reversals, chargebacks, or related costs arising from your connected account activity, you authorise TradeBooked to recover those amounts from you by any lawful means, including set-off, invoicing, or restriction of service. TradeBooked may impose risk controls where reasonably necessary, including pausing deposit collection, requiring additional verification, or temporarily disabling payment features while risk or compliance issues are investigated. 7. AUTOMATED COMMUNICATIONS TradeBooked sends automated messages on behalf of tradespeople as part of the service. These include: - booking confirmation emails and SMS messages sent to customers when a booking is created or updated - appointment reminder emails and SMS messages sent to customers before a scheduled booking - running-late SMS alerts sent to customers where triggered by the tradesperson - booking notification emails and push/Telegram alerts sent to the tradesperson - rebooking campaign messages sent to past customers where the tradesperson has configured and activated a campaign - review request emails sent after a completed job, where enabled As the tradesperson, you are responsible for ensuring that any automated messages sent through your account comply with applicable law, including the Privacy and Electronic Communications Regulations (PECR), UK GDPR, and any applicable SMS or email marketing rules. You must not use automated communications features to send unsolicited marketing to individuals who have not consented, where consent is required. Customers may opt out of SMS messages by replying STOP to any SMS. Email unsubscribe links are included in all non-transactional emails. We will honour opt-outs promptly. 8. CUSTOMER REVIEWS TradeBooked provides a review and rating feature that allows customers to leave feedback following a completed booking, where enabled by the tradesperson. You must not manipulate, fabricate, or selectively suppress reviews. You may respond to reviews posted on your page. We may remove reviews that contain unlawful content, are demonstrably fraudulent, or otherwise violate these Terms. We will not remove a legitimate review solely because it is unfavourable. 9. AI AND TRADE ASSIST FEATURES TradeBooked may include AI-powered features to assist tradespeople with diagnostic suggestions, job notes, or other trade-specific information (the "Trade Assist" feature, where available). AI-generated suggestions are provided for informational purposes only. They do not constitute professional advice and may not be accurate, complete, or suitable for your specific circumstances. You are solely responsible for any professional decisions you make and for the quality of work you carry out. Do not input sensitive personal data about your customers into AI features beyond what is necessary for the feature to function. Usage of AI features may be logged for service improvement and safety purposes. 10. CONSUMER CANCELLATION RIGHTS TradeBooked subscriptions are primarily sold to businesses. If you purchase a subscription as a consumer (rather than in the course of business), you may have statutory cancellation rights under applicable consumer protection law. If you request that the service begins during the statutory cancellation period, you acknowledge that the digital service may start immediately. Where permitted by law, your right to cancel may be reduced or lost once the digital service has been fully supplied. Nothing in these Terms limits or excludes statutory rights that cannot be waived. 11. ACCEPTABLE USE You must not: - use TradeBooked for unlawful, fraudulent, deceptive, or misleading activity - impersonate another person, business, or trade - use the platform to harass, threaten, or abuse any person - interfere with or attempt to disrupt the platform, its infrastructure, or other users - attempt to bypass, probe, or circumvent security controls - use automated tools to scrape, harvest, or extract data without our written permission - access another user's account or data without authority - upload or transmit material that is unlawful, abusive, defamatory, obscene, or infringes third-party rights - use the platform to send spam or unsolicited communications - resell, sublicence, or otherwise exploit the platform without our written permission We may remove content, suspend features, or terminate access where reasonably necessary to enforce these Terms or to protect users, third parties, or the platform. 12. YOUR RESPONSIBILITIES AS A TRADESPERSON You are solely responsible for: - the services you offer, advertise, and carry out - your pricing, availability, and all communications with customers - holding all necessary licences, qualifications, insurance, and certifications required for your trade - your health and safety obligations in carrying out work - complying with applicable law — including consumer protection law, tax law, data protection obligations, trading standards requirements, and any trade-specific regulations - resolving all disputes with your customers - ensuring your booking page content is accurate, lawful, and not misleading 13. CUSTOMER DATA AND DATA PROCESSING You retain responsibility for the customer and booking data you collect and process through your use of TradeBooked. You grant TradeBooked the rights necessary to host, store, process, transmit, and back up that data to provide, operate, and improve the service. Where TradeBooked processes personal data on your behalf as a processor, you instruct us to do so only as necessary to provide the TradeBooked platform and related services. You are the data controller for your customers' personal data and are responsible for your own data protection obligations under UK GDPR and the Data Protection Act 2018, including providing appropriate privacy notices to your customers. Our processing of personal data is described in our Privacy Policy at tradebooked.co.uk/privacy. By using TradeBooked you acknowledge and accept that policy. 14. SERVICE AVAILABILITY AND MODIFICATIONS We aim to provide a reliable, high-quality service. We do not guarantee uninterrupted availability or error-free operation. We may suspend or limit access temporarily for maintenance, upgrades, security work, payment issues, abuse investigation, or circumstances outside our reasonable control. We will endeavour to give advance notice of planned maintenance where practical. We may add, modify, or remove features from time to time as the platform evolves. Where a change materially affects features available on your current plan, we will take reasonable steps to notify you in advance. 15. THIRD-PARTY SERVICES AND INTEGRATIONS TradeBooked integrates with third-party services to provide certain features, including Stripe (payments), Resend (email), Twilio (SMS), Google Calendar (calendar sync), Printful (merchandise), and others. We are not responsible for failures, outages, or changes in third-party services outside our reasonable control. Where you connect a third-party account (such as Google Calendar), you are also subject to that provider's terms of service. We will only access connected accounts to the extent necessary to provide the relevant feature. 16. SUSPENSION AND TERMINATION We may suspend, restrict, or terminate your access if: - you breach any of these Terms - you fail to pay subscription fees and the arrears remain outstanding after notice - we reasonably suspect fraud, abuse, or unlawful activity - continued access creates security, legal, reputational, or operational risk - we are required to do so by law or a regulatory authority Where practicable, we will give you prior notice before taking action. In urgent cases involving safety, security, or serious misconduct, we may act without notice. You may stop using the service or cancel your subscription at any time through your account settings. On account closure, we may retain data for a reasonable period to allow data export, comply with legal obligations, resolve disputes, or prevent fraud. Data handling on closure is also described in the Privacy Policy. 17. INTELLECTUAL PROPERTY TradeBooked — including its software, code, design, branding, features, and platform content — belongs to us or our licensors and is protected by applicable intellectual property law. These Terms do not give you any ownership of or rights in the platform itself beyond the limited licence to use the service described below. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use TradeBooked during your active subscription solely for your legitimate business purposes and in accordance with these Terms. This licence ends automatically if your subscription lapses or your account is terminated. You retain ownership of your own business data, customer data, and content you upload to the platform. 18. LIABILITY Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation. To the maximum extent permitted by applicable law: - TradeBooked is not liable for indirect, consequential, incidental, special, or punitive loss of any kind, including loss of profits, revenue, data, business, or goodwill, even if we have been advised of the possibility of such losses - TradeBooked is not liable for disputes, complaints, claims, or losses arising between you and your customers - TradeBooked is not liable for losses arising from third-party service failures outside our reasonable control - Our total aggregate liability to you for all claims arising out of or related to these Terms or the service will not exceed the total fees you paid to TradeBooked in the 12 months immediately preceding the event giving rise to the claim 19. CHANGES TO THE SERVICE OR THESE TERMS We may update these Terms from time to time. If we make a material change, we will notify you at least 30 days before the change takes effect — for example, by email or an in-app notice. Minor or clarificatory changes may take effect immediately. Continued use of TradeBooked after a change takes effect constitutes your acceptance of the updated Terms. If you do not accept a material change, you may cancel your subscription before it takes effect. 20. GOVERNING LAW AND DISPUTES These Terms are governed by the law of England and Wales. Any dispute arising from or in connection with these Terms or your use of TradeBooked will be subject to the exclusive jurisdiction of the courts of England and Wales, unless applicable mandatory law in your jurisdiction provides otherwise. We encourage you to contact us first at compliance@tradebooked.co.uk to resolve any dispute informally before commencing legal proceedings. 21.
